Maine: Notice of Opportunity to Comment - Proposed Amendment Rules for Guardians ad litem

The state of Maine is looking to amend the rules for Guardian Ad Litem's which are basically lawyers appointed by judges for your children in custody battles.  GAL's are appointed in both divorce cases and Child Protection matters, where they can sign off on what the state asks for and secure a contract until the kid turns 18 and ages out of foster care.

The problems with the current rules include everything from billing parents thousands of dollars for their services by dragging everything out, to unfairly siding with one parent over the other so that the parent (usually fathers) lose access to the child, to committing fraud on behalf of DHHS in CPS cases.  

The court is asking for comments on the new rules and amendments.

I have sued DCFS more than a dozen times and have established, through federal court findings, that the state’s child-welfare system has a staggering rate of error in its investigations. On Friday the Cherokee Nation came out swinging in their response to the motion filed weeks ago in Nowata, Oklahoma county court in Adoptive Couple v. Baby Girl, in which Matt and Melanie Capobianco are seeking approximately copy million in attorneys' fees and costs. Their recent filing in Oklahoma is the second jurisdiction in which they have sought compensation in the four-year custody battle that ended in September when Dusten Brown relinquished his biological daughter to the Capobiancos after losing at the United States Supreme Court in June. Immediately following the child's transfer in September, the couple filed similar litigation in South Carolina seeking roughly $500,000 in that state.

The news media in Arizona has obviously lost touch with the reality of the fact that just because some idiot makes a phone call doesn't mean that you automatically need to send a nasty babystealing social worker to make sure the family is safe.  And to think, the fact that they're preaching that CPS can be trusted for the job proves that they're as full of shit as a Thanksgiving turkey.

Therefore I will take this opportunity to explain that when you let the media go off on stuff like this, without adequately stating the fact that too many calls to the child abuse hotline can overwhelm an already overburdened and highly problematic failure of a system, and suddenly pushing additional demands onto that same system by stating that "Oh my God!  They're not doing enough," and demanding that they investigate every call, without asking why and automatically pumping millions more into it to fix it...


It will only make things worse.

What they are lacking is an adequate screening process for hotline calls, in which case they would reduce the number of investigations simply because every phone call to the hotline should not automatically mean that a kid is in danger.  Some calls are made by neighbors who hate you, some are because a vindictive ex is trying to get the upper hand in a custody battle by making a false accusation.  But look at the wording they use.  "
Child Protective Services workers simply decided, based on the information from a phone call, that they were not important enough to follow through."
"85% of all child abuse reports are unfounded"
NO DUMB-ASS!  Perhaps the information provided in said phone call didn't rise to the level where an investigation would be legally or ethically warranted.  In other words, that simple little scrape on the knee that Little Johnny got while running around outside last night whit his friends, and that you forced that teacher to rat the parents on via threat of jail, fines and their credentials, isn't actually worth expenditure of the limited resources, considering the fact that there had never been any prior indication of child abuse in the past, and bla bla bla... etc.

Didn't the fact that 'shit happens' ever cross your mind?  Have you ever heard of the 4th amendment of the US Constitution?  Perhaps you should look it up.  Perhaps they should at least have good reasons to fuck with people.  Is a simple phone call from one asshole to another really a good enough reason?

What is the world coming to?

BTW, for the parents in Arizona who fall victim to all of this on behalf this fanatical overreaction of a phony mountain out of a mole-hill news story, I offer the following advice.




If it goes beyond that, than I urge you to contact AFRA and learn how fight CPS the right way.

Handcuffed boy's family: We've reported this abuse

If anything demonstrates societies lust for blood, it's how stories like this blow up in the news media.  Headlines like this cause people to buy newspapers as they are attention grabbing and I believe that every major news outlet in this country has probably presented this single story at least once by now.  Meanwhile, the state will pass some unpopular proposal behind the scenes, such as pumping more money into CPS so they can fix these kinds of problems, while the sheep are distracted.  I mean this was an outrageous case, but these kinds of high profile cases tend to benefit CPS who is then put under the microscope to find that the workers can't keep up due to heavy case loads, shortages of good homes thus forcing them to lower their standards crossed with a lack of training and proper background checks, workers not visiting the families every 30 days, etc.  The solution to this, of course, is more money.  That's what will ultimately happen because the anti-abuse mob have been given their springboard to hit up the tax payer.

It's all manufactured need.   "What!" cryeth the system suck, "you think that poor helpless child is manufactured?"

No Dumbass.  But this is a one of a kind case.  I hardly doubt that you will find very many kids, even in foster care, who are handcuffed to porches with dead chickens around their neck.  But everybody will have to suffer because of it.

This is a total sales pitch.  I am very sorry for posting this as it will probably turn your stomach, but if any of you actually want to have a clue as to where the money really goes, it's necessary.

I am appalled at what they're not telling you.  Opportunity Alliance is actually a private agency that provides Targeted Case Management Services for which they can bill Medicaid and government grant programs, in this case, SS Title IV as well.  They work with kids in and out of foster care so there are many opportunities for them to bill.

This particular kind of foster care is worth big bucks.  The people who are going through programs like this will be some of the highest paid foster parents in the state.  In light of the closing of Casey Family Services, Maine is also an opportunity state for System Sucks like this, as the state must scramble to find other service providers.  Opportunity Alliance, Youth Alternatives, PROP, etc all provide these kinds of services in Maine and other states.

Logan River Academy says abuse allegations are false

In a press release from Logan River Academy, it is stated that students receive professional help and care, and that recent allegations made of abuse are false. Logan River Academy is a treatment center for struggling teens between the ages of 12-18. A handful of students who attended the Academy are now expressing concerns with the treatment they received, claiming they were abused and left in seclusion for long periods of time. Anonymous, an international network of activists and hacktivists, is now targeting Logan River Academy through social media. The hashtag the group has been spreading on Twitter is #ShutLoganRiver.

Los Angeles County fined for delays in placing foster children into homes

State regulators have begun imposing fines on Los Angeles County for not placing children in foster homes quickly enough. It has cited the county for dozens of "overstays" in facilities not designed for long-term housing. It is believed to be the first time a county in California has been fined for overstays: The violations that took place in September totaled $600.
