COVENTRY FAMILY GET JUSTICE AT LAST

A Family that faced being torn apart, after Social Services became involved, due
to an expert witnesses report have won a very lengthy family court hearing in
Coventry.

The Parents who have to remain anonymous to protect the identities of the
children are overjoyed with the verdict of the judge.

Social Services became involved after Mum was diagnosed with MSBP by a
Paediatrician, who had never met the children, or the mother. There were
concerns that the children were being taken to hospital for very trivial
problems and that her anxieties were having a detrimental effect on the well
being of the children, this professional was not adequately qualified to make
such a diagnosis and this must be made by a consultant Psychiatrist.

A family holiday to Egypt was cancelled at the last minute due to a Guardian ad
items concerns about an incident, two days previously, in which one of the boys
fell over and injured himself at a family wedding, he was taken to hospital and
was found to have no apparent injury, this information was brought out in court
several days later.
The Guardian suggested in so many words, that the children were put at risk
again, due to the hospital visit.

The Judge was advised by the Guardian to obtain all of the family passports and
the children were then taken to the Cafcass offices, with no family member
present and were told that the holiday which was booked and paid for many months
before, was cancelled.
The following week was a nightmare due to the family more or less being under
house arrest, as there was going to be several visits a day by Social Workers to
the family home.
Due to the professionalism of the children’s panel solicitors recommended by the
national organization Parents Against Injustice, the family managed to stay
together at home on an interim care order, if things had of gone wrong, the
Local Authority were going to place the three children with separate foster
carers.

The family were put under a very strict regime. All rooms in the house were
requested to be photographed by the Social Services, but this was apposed by the
Solicitor, who was successful in his opposition.

There was 28 allegations made by Social Services later to be disproved, the
whole family court scenario looks like it has been a farce, Judge Bellamy was so
concerned by the way this family have been treated, that he has ordered that the
judgment will be shown on the internet on or after the 12th April 2010, which
only usually happens in high profile, high court cases.


After a final case conference yesterday, the children’s names were removed from
the child protection register, and there will be no more Local Authority
intervention, the whole case has cost £100,000 of the tax payers’ money.

Brendan Fleming the family’s solicitor states there is a good chance the trauma
caused could be compensated via a court hearing and is willing to offer his
services.
Very few individuals have won their cases to sue Social Services for perceived
injustice.
Other new guidelines will follow regarding care proceedings, which will be
debated by the Justice Ministry, regarding mistakes made in this case.

Alison Stevens’s chairperson of Parents against Injustice, who advised the
couple and attended court on several occasions says “I am absolutely delighted
that our help and advice given, has saved the family from the grief and trauma
of miscarriage of justice and forced adoption, that many other parents are
experiencing at the moment in the present climate and since the baby Peter
tragedy”.
