A Neenah woman who suffocated her 2-year-old son was found not mentally responsible Tuesday.

Testimony showed Brenda Thiel, 28, had spoken of harming her children after she attempted suicide March 31, only six weeks before the death of her son, Caleb.

Thiel, a former part-time employee of Winnebago County's Child Welfare Division, was kept in the psychiatric ward at Theda Clark Medical Center from the day of her suicide attempt until April 8. The boy died at their home May 5.

But exactly what happened to the child plaintiffs -- including the child known as David C. who was abused in foster care -- is unclear as lawyers struggle to locate them. All of them have left state custody and are now adults.

The 33-page report details a litany of record-keeping and security troubles at the New York State Office of Children and Family Services, and accuses the state agency of improperly saving records of expunged child abuse cases it should have shredded and destroying telephone records it was supposed to keep.

This article argues that since the passage of the Child Abuse Prevention and Treatment Act (“The Mondale Act”) false claims of child abuse have wrecked havoc on American families. In order to understand the claims for immunity made by doctors, social workers and attorneys who mis-serve children, this article provides a discussion of immunity and its operation in our law. Following a historical overview, this article describes the various claims to immunity from suit made by government officials, prosecutors, law enforcement personnel, guardians, appointed counsel, social workers and various private parties. Robley Carr Jr., according to his lawyer, was a victim of the state Department of Social and Health Services' (DSHS) mistakes. He was a victim not once, but twice. In 2003, state and federal authorities paid $5 million to settle claims that Robley and three siblings were horribly abused in foster care. Now, the state has agreed to pay an additional $320,000 to settle a claim that it failed to protect Robley even after that. He died at age 15.

Foster Parents Call for Foster Care Overhaul

Some foster parents are demanding an overhaul of the foster care system. They met in Milwaukee Wednesday to protest the beating death of a baby in foster care last month.
Rebecca Welk organized the protest in front of the child welfare office on the city's south side. Welk is a former foster mother who's outraged by the death of Christopher Thomas. The 13-month-old baby died in early November, after being severely beaten. His foster mother -- who was also his aunt -- is accused of causing his death. Welk also blames the boy's social worker, saying she failed to recognize signs of ongoing abuse.

"In Christopher's case the woman did not do her job. She is -- as far as I'm concerned -- she's as much at fault as the foster parent. She needs to be punished for what she did," Welk says.

Welk says she's witnessed numerous problems with the foster care system over the years, and feels it's finally time to take action. She and the other protesters say they're demanding justice for Christopher and for any other children who've been abused while in foster care.

The protesters are circulating a petition, spelling out what "justice" means for them. Foster mother Donna Pluta-Eisenmann read from the document: "...that the abuser is punished to the full extent of the law and serves the full sentence..."

Pluta-Eisenmann says the group has other demands, including improved training of foster care workers, and better screening of foster homes.

"There are so many unfit foster parents that shouldn't be fostering, because these children go into these foster homes and they're being abused, they're being neglected, they're going from one bad situation into another bad situation and that's not fair to this child," Pluta-Eisenmann says.

Cyrus Behroozi heads the state division that oversees the foster care system and the Bureau of Milwaukee Child Welfare. He's sympathetic to the protesters.

"We've had a terrible, terrible tragedy in Milwaukee County. We first have to acknowledge that we've had a terrible tragedy. We respect the public's right to let their opinions be heard and we will listen to and work with that public and that community to do the best job that we can," Behroozi says.

Behroozi admits that there have been problems with some foster care workers and some foster families. He says his division is continually working to improve the system and to keep foster children safe. Behroozi promises to find out what went wrong in the Christopher Thomas case.

"We're going to be looking at this particular case in a way that we never have before, utilizing members of the community -- professionals in the community -- so that if there is any way that we can do a better job for kids we will continue to drive for improvements for children in Milwaukee County," Behroozi says.

One person who'll be waiting for answers is Rebecca Welk, who organized the protest.

"I have a big mouth, I'm not afraid to use it, they can slam doors in my face, I will keep knocking until somebody opens it and talks to me, that's all I can do," Welk says.

Welk says she's so dedicated to this cause because she adopted a baby girl who was removed from her parents after being severely abused.

These well-meaning family members are denied that chance by a foster care system that fails to work with them in any meaningful way. The system also fails to provide effective services to address problems in the home, many of which are rooted in poverty. (Poverty-related neglect is the No. 1 reason children are removed from their homes in the first place -- not serious physical or sexual abuse.)

When dss takes your kids you are in for a long battle. prepare to cry, stay up worrying all night. you will be lied to, promised things you' you will not get etc. at this time they have my granddaughter. i was under the belief that i would get her back, possibly in weeks. its been months and i don't see it happening anytime soon. i have talked to lawyers,senators,child psychologist and many many others and their response is that dss is like the Gestapo, judge, jury and executioner. the judges do as they say; also the lawyers,therapists, doctors and every one but you. the best advice given to me and you MUST follow this to get your child back. SHUT UP. do not tell them anything but name, rank, and serial #. Be as nice as possible, but do not give them info to use against you. DO NOT sign anything without an attorney telling you to.

Be nice and say your lawyer said not to sign anything until he gives you permisssion, this makes him look like the bad guy and not you.They had my son sign an agreement to go to mental health, aa meeting, anger management and so on. he did not read it but was told it was just a formality to get his dauhter back. now in their reports he is mentally unstable, an alcoholic, and physically abusive. all lies. thses people are very sneaky. they pretend to be you best friend and the entire time r trying to gather info to use against you. best advic; get an attorney if at all possible. Do not use one of theirs or a court appointed one as most get their work form dss and are not going against them. if you cannot afford an attorney try to find one that will do it pro-bono. some can be found on the internet. also a law was passed in the 90s to give bonuses if dss was able to get your child adopted. they can do this after a year and they will.

ps my granddaughter was taken because someone that didnt like him called child protective services on him. he had drank 2 beers. they would not breathalize him or even listen. My grandchild had been bathed, eatten and was in bed.
