Parental Alienation: A Serious and Growing Problem in Family Law Cases

Some of the issues facing parents involved in a divorce or paternity action involving child custody are not specific to New Mexico, but occur all over the United States. One such issue, which has become increasingly recognized by family law courts during the last 20 years, is the concept of parental alienation.

Parental alienation is generally discussed in the context of a contested custody dispute, although elements of parental alienation can certainly be found in intact families. When the research about parental alienation first began being published, it focused on situations in which one parent sought to alienate the child from the other parent by doing things like preventing visitation between the child and the other parent and bad-mouthing the other parent to the child. Frequently, one parent would go so far as making false allegations in court to prevent the other parent from seeing the child.

Foster parents have a legal right to compensation for the actual cost of providing children with housing, food, clothing and other care required by the state, a federal appeals court ruled Monday.

New state laws were supposed to safeguard kids who are living in potential danger from family members. They did not shield 6-year-old Michael Ibarra. He died Aug. 3.
Because they make it sound like missing one kid is representative of the whole.
Michael is the sixth Pima County child to die in recent years while under the watch of state Child Protective Services. Each killing spurred outrage and demands that things be done better, that children be saved from the relatives who do them harm. "Reforms" were put in place in 2008.

Little, it appears, has changed. We say "appears" because CPS won't talk about Michael on grounds that it might harm the criminal case.
It appears that these workers are supposed to have the Chrystal Balls, and the psychic ability to look into the future with 100% accuracy. The reality will be that if enough public pressure is put on them, ie. the feminazi's start holding their protests in front of the state capital crying out that more needs to be done to protect all of the children, you're going to see more and more kids getting snatched for frivolous reasons and thrown into foster care. You're going to see more families being falsely accused as the awareness campaigns kick in.

Some workers are just stupid. Some workers couldn't recognize a rip in a paper bag. Some workers have never had kids but go out into the fields as the great experts on parenting. Some are overworked, so they say.

They already have the power to snatch kids on a whim. They just gotta learn how to pick the right ones.

You, however, need to recognize propaganda and social conditioning tactics. CPS fucked up. The workers assigned to this case should be held accountable. There was clearly a severe performance issue on the part of the caseworkers in this case. That, is doubtfully representative of the whole.

It will, however, help to increase funding, as they hire, train and employ more caseworkers to snatch more children.

Chris Gottlieb defends parents for a living. She is with the Family Defense Clinic at New York University School of Law, which represents parents accused of child abuse and neglect and tries to keep families together. With that daily backdrop, she read our discussion here a few weeks ago — the one about parents judging other parents harshly — through a somewhat different lens.

She had recently published an article in the University of Baltimore Law Review about “how the tendency to judge mothering harshly plays out for the poor and minority women who come under the scrutiny of the child welfare system.” She has adapted that article as a guest blog today — describing how her own experiences as a mother (her children are four and one) help her understand how it feels to be judged, and give her some insight into the feelings of her accused clients.

Many of you will disagree with her conclusions. But you will agree that her vantage point is one that most of us don’t usually have.

JUDGING MOTHERING

A woman approached on the subway to tell me that looking at newsprint up close could cause eyestrain. I quickly learned she was not worried about me; she was concerned about my baby’s eyes because I was carrying him face out, where he was about six inches from the newspaper I was reading. An elderly man chastised me because my baby’s legs were not covered. A saleswoman was more worried about his arms, but didn’t stop at commenting — she reached out to pull down his sleeves. Several strangers “tsked tsked” me when they learned I had my baby out of the house before he was six weeks old. I have been criticized for failing to have mittens on him, keeping him up too late and for drinking hot coffee while holding the little guy.

Maybe this onslaught should make me wonder about my mothering skills, but instead I marvel at how comfortable people feel telling complete strangers about their purported parenting flaws. I am certain that over the years, fellow subway riders have judged my fashion choices and found them wanting, or disapproved of what I was eating (or that I was eating on the train). Yet no one has ever voiced such opinions to me. But the discretion of strangers disappears as soon as you have a child, in fact, as soon as you are visibly pregnant. Heaven help you if you have a beer in public while expecting.

No infraction is too small or too strange to elicit comment. (The newspaper was too close to the baby’s eyes?) All my parent friends have experienced this no-win culture of judging parenting. Depending on their personalities, they have cowered, gotten angry or been demoralized by it. Yet as stinging as the comments and glares can be, for most of us they are limited to park benches and supermarket lines or, if we’re unlucky, to visits with the in-laws. Our culture of judging parenting by impossible standards hits some much harder.

Only after I had children did I truly begin to understand what I thought I already understood after years of standing beside my clients in family court: parenting is something we are inclined to judge harshly at the same time that it is impossible to do in anything but an extremely flawed way. You can’t get it right. We all know this. We all strive for greater excellence than we have hope of achieving. Yet we couple this knowledge with extreme intolerance for the shortcomings of other parents.

I represent parents accused of abusing or neglecting their children — few are more deeply despised in our society. If you know these parents through media coverage, you likely think we must do more to protect their children. The thing is, in the vast majority of cases, the ones these children most need to be protected from is not their parents. It is us. For we have empowered the government to judge parents and when the parenting is found wanting, to take children.

Certainly some children need to be separated from their parents and put in foster care. But only in rare situations is such a traumatic step justified. Yet over and over, I have seen caseworkers who investigate parents and judges who oversee intervention in family life hold parenting up for assessment and inevitably find that the parents fall short. Why? Because the standards imposed are as idiosyncratic and impossibly high as the standards of the people I hear from on the subway. The caseworkers and the judges, however, have the guns to back up their glares.

Contrary to the media images of severely abused children who have suffered and died at the hands of abusive parents, the vast majority of cases that clog the foster care system involve allegations of neglect, not abuse. And neglect is broadly construed. Parents are charged for refusing to give their children psychotropic medications, for using corporal punishment, for having a dirty home, for smoking marijuana. In other words, neglect includes many things that reasonable people have very different ideas about. Indeed, it includes many behaviors that my yuppie friends and I engage in without threat of government intervention.

Yet we allow, indeed encourage, government officials to be judgmental of the poor and minority parents who interact with the child welfare system. Despite clear constitutional law protecting the right of parents to raise their children as they see fit, one need only walk into family court to see this law routinely breached.

We have not sufficiently connected the phenomenon we observe in our own lives — of widespread willingness to impose perfectionist standards on parenting — with the explosion of inflammatory media coverage of child abuse and hyper-aggressive child protection policies. Legitimate efforts to protect children from serious abuse have morphed into second guessing decisions well within parental prerogative. Worse still, once government intervention in family life is authorized, the legal standard often becomes “best interests of the child.” How do courts and caseworkers determine what is in a child’s best interests? The same way the rest of us do: subjectively, inconsistently, and often erroneously. One judge wants more discipline; another wants less. I have heard caseworkers criticize mothers for everything from giving their children Chinese takeout food or Kool-Aid (the mother told me orange juice was too expensive for her) to having beer in the house to letting a child get wet under a sprinkler. A judge ordered one of my clients to take her child to the park every day. Every day! How can that level of micromanagement of parenting by the government make sense?

It is time to reevaluate our inclination to approach parenting with such unforgiving eyes — in our own lives and in our public policies. We would serve children far better if we viewed parenting by strangers as we view the parenting of our partners and friends when we are at our best: generously, with commiseration rather than a measuring stick. If we are going to interject, we might even consider offering support rather than judgment.

How to piss off a blogger,

To all of my beloved readers. I have got to tell you of my experience over the last couple days.

It all started this past Sunday morning when I opened up my email, and see 13 purchase conformations from my PayPal account for a total of $513 dollars worth of iTunes movie downloads. Thinking these may have been spoof emails, I immediately logged into my PayPal account to see that in fact $513 dollars was in fact charged to my PayPal account for purchases that I did not make through iTunes, which, btw, I haven't even used since February of 2009 for a couple of free downloads.

I have got to say, thanks to the wonderful security team over at PayPal, as well as the people at my bank, I have lost absolutely nothing, my accounts are secure, all funds have been returned to me within 48 hours, and it is now between PayPal and http://www.apple.com/. However, as was suggested to me by my boy at PayPal, who BTW, was extremely knowledgeable, helpful, courteous and showing genuine concern for my problem, and eager to take action to prevent any further fraudulent activity through my PayPal account, I contacted, or rather attempted to make contact with the right people at iTunes.

However, what I encountered at iTunes was the most complete bunch of useless fucking morons in a call center in Huston Texas, that I have personally ever encountered. If I had a dime for every time one of those assholes told me that, "There's nothing that we can do about it at this point," I would have been able to repay my bank for all 13 of those fraudulent transactions, and a weeks worth of gas and groceries.

When calling iTunes at the number provided on the iTunes website, which is 1-800-MyApple or rather 1-800-692-7753, there was nobody to help you disable the account, nobody to help you to block future fraudulent transactions, nobody to report fraudulent activity to. You see, iTunes doesn't actually offer phone support, and the reason for that is that apparently so many people have been hit with this, according to this article from PC World, that iTunes can't keep up.

No, what these idiots who can't help you tell you to do is send an email to the iTunes security team, and within 24 to 72 hours, they will get back to you via email, after they review the account they will get back to you with an email explaining what they will do for you. So, after my like 20th phone call to 1-800-MyApple, after they charged $513 dollars of fraudulent transactions to my paypal account, which ultimately hit my bank account, a day after I put a block on that, there was damn well somebody who was going to deal with this issue or they were going to get me into contact with the right people, whatever. So they put me through to somebody who answers the phone in French, and was just as stupid as the rest of them. Me no speako elFrencho la-dipshito! Get it?

So, until I am issued a personal public apology from Steve Jobs himself, and he personally presents every member of my family with a new, free, top of the line MacBook, and IPad, and adds an adequate security team to iTunes, this post will remain on LK, and you are all free to spread the word, and be warned to avoid all use of iTunes and disable all payment methods to that site which does nothing to prevent fraudulent activity. Because, quite frankly, iTunes customer service sucks, and I am especially referring to, Janet, Carlos, Bryce, Ronda and Linda from the Huston Texas Call Center. These people are as useless as the tits on a bull.
