Court of Appeals: Judges cannot impose their own morality

An interesting decision was issued this week by the Michigan Court of Appeals in the divorce case of White v White. In White v White, a divorce case out of Macomb County Circuit Court, the parents divorcing had not resolved who was to have custody of their children. Ultimately, if the parents cannot decide who is to have custody, a judge or arbitrator will make the final decision. However, prior to the time of trial, the parents in White finally did reach a decision on all issues, including custody.
