Adopting children but foster mother claimed them on her taxes?

My husband and I are in the processes of adopting 3 boys that were in foster care. The boys were place with us in September. We have an adoption agreement and the adoption will be final next month. We were planning on claiming all 3 boys on our tax return but their foster mother informed us that she had already claimed them. I have talked to a tax consultant and she informed us that since we have an adoption agreement through the state that we are the ones that have the right to claim them. Is this correct? Any advice would be greatly appreciated.

Note: And this has nothing to do with the money, eh?

    I don't think you can claim you provided 50% of the support if they're in foster care. Therefore, you not eligible to take the deduction.
