The removal of 462 children from their parents at the polygamist compound in Eldorado, Texas, could very well be unconstitutional, despite the fact that District Judge Barbara Walther decreed it. At issue are the First Amendment rights of freedom of religion and speech.Recent comments from a spokesman for the state's Child Protective Services unwittingly reveal that the confiscation of children from parents goes beyond illegal polygamy and statutory rape of minors. It appears the state just doesn't like the religion of the kids, their parents and compound leaders.
